O novo modelo opera sob o princ\u00edpio da n\u00e3o cumulatividade: empresas que tomam servi\u00e7os de prestadores pessoa jur\u00eddica (PJ) com nota fiscal regularmente emitida poder\u00e3o utilizar os tributos pagos como cr\u00e9dito, reduzindo o valor a recolher em suas opera\u00e7\u00f5es.<\/p>\n<p>Para empresas que contratam prestadores PJ em escala, a mudan\u00e7a representa um incentivo fiscal que depende diretamente da qualidade da documenta\u00e7\u00e3o. Segundo a&nbsp;<a rel=\"follow\" href=\"https:\/\/www.reformatributaria.com\/opiniao\/ibs-e-cbs-em-2026-como-funciona-a-convivencia-com-os-tributos-atuais-segundo-a-lc-no-214-2025\/\">regulamenta\u00e7\u00e3o detalhada no Portal da Reforma Tribut\u00e1ria<\/a>, o artigo 348 da LC n\u00ba 214\/2025 estabelece que 2026 funciona como per\u00edodo de adapta\u00e7\u00e3o: IBS e CBS j\u00e1 devem ser registrados nos documentos fiscais, mas os contribuintes ficam dispensados do recolhimento efetivo. Ap\u00f3s esse per\u00edodo de adapta\u00e7\u00e3o, o recolhimento passa a ser obrigat\u00f3rio e os cr\u00e9ditos ter\u00e3o efeito financeiro direto.<\/p>\n<p>A reforma tamb\u00e9m alterou a din\u00e2mica para prestadores PJ enquadrados no Simples Nacional. Conforme previsto na&nbsp;<a rel=\"follow\" href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/lcp\/lcp214.htm\">LC n\u00ba 214\/2025<\/a>, empresas optantes pelo Simples podem aderir ao regime h\u00edbrido, recolhendo IBS e CBS por fora do Documento de Arrecada\u00e7\u00e3o do Simples (DAS). Nessa modalidade, a nota fiscal emitida pelo prestador PJ passa a gerar cr\u00e9dito para a empresa contratante. Dados do&nbsp;<a rel=\"follow\" href=\"https:\/\/www.infomoney.com.br\/minhas-financas\/tst-faz-alerta-sobre-riscos-com-avanco-da-pejotizacao-e-levanta-discussoes\/\">Minist\u00e9rio do Trabalho e Emprego (MTE)<\/a>&nbsp;indicam que 5,5 milh\u00f5es de profissionais sa\u00edram diretamente do regime da&nbsp;<a rel=\"follow\" href=\"https:\/\/managefy.com.br\/blog\/nova-lei-trabalhista-pj\/\">Consolida\u00e7\u00e3o das Leis do Trabalho (CLT)<\/a>&nbsp;para contratos PJ entre 2022 e 2025. A escala dessa migra\u00e7\u00e3o amplia tanto o volume de notas fiscais que as empresas contratantes precisam processar quanto o potencial de cr\u00e9ditos a serem aproveitados \u2014 desde que a Folha PJ esteja documentada.<\/p>\n<p>A tomada de cr\u00e9dito sobre servi\u00e7os de prestadores PJ exige que a empresa contratante mantenha tr\u00eas elementos documentais em ordem, conforme previsto na legisla\u00e7\u00e3o: nota fiscal de servi\u00e7o eletr\u00f4nica (NFS-e) emitida pelo prestador com dados corretos, Cadastro Nacional da Pessoa Jur\u00eddica (CNPJ) do prestador ativo e regular, e pagamento vinculado \u00e0 nota fiscal correspondente. Se qualquer desses elementos estiver ausente ou inconsistente, o cr\u00e9dito n\u00e3o pode ser aproveitado.<\/p>\n<p>F\u00e1bio Rodrigues, especialista em gest\u00e3o operacional de prestadores PJ com 22 anos de experi\u00eancia em consultoria e fundador da Managefy, plataforma de gest\u00e3o de prestadores PJ para empresas, identificou um padr\u00e3o que pode dificultar o aproveitamento desses cr\u00e9ditos. Em levantamento conduzido com 68 empresas contratantes entre 2024 e 2025, 100% relataram que o pagamento a prestadores PJ n\u00e3o \u00e9 vinculado sistematicamente \u00e0 nota fiscal em algum momento do ciclo mensal. &quot;A empresa que n\u00e3o vincula pagamento \u00e0 nota fiscal perde o direito ao cr\u00e9dito. A&nbsp;<a rel=\"follow\" href=\"https:\/\/managefy.com.br\/gestao-pj\/\">Folha PJ<\/a>&nbsp;estruturada resolve isso como parte do processo&quot;, afirma Rodrigues.<\/p>\n<p>O conceito de Folha PJ, que descreve o ciclo completo de&nbsp;<a rel=\"follow\" href=\"https:\/\/managefy.com.br\/blog\/folha-de-pagamento-pj\/\">recebimento de nota fiscal, valida\u00e7\u00e3o de dados, aprova\u00e7\u00e3o e pagamento rastre\u00e1vel<\/a>, ganha uma nova dimens\u00e3o com a reforma tribut\u00e1ria, segundo Rodrigues. Empresas que processam a Folha PJ de forma estruturada geram automaticamente a trilha documental que a legisla\u00e7\u00e3o exige para a tomada de cr\u00e9ditos. Empresas que processam pagamentos via planilha, e-mail ou transfer\u00eancias banc\u00e1rias sem refer\u00eancia \u00e0 nota fiscal n\u00e3o conseguem comprovar o v\u00ednculo entre servi\u00e7o tomado e tributo recolhido.<\/p>\n<p>A transi\u00e7\u00e3o regulat\u00f3ria em curso no Brasil \u2014 que inclui tanto a reforma tribut\u00e1ria quanto a defini\u00e7\u00e3o de crit\u00e9rios para contratos PJ pelo Supremo Tribunal Federal (STF) no Tema 1389 \u2014 refor\u00e7a a necessidade de documenta\u00e7\u00e3o fiscal estruturada por parte das empresas contratantes. O per\u00edodo de adapta\u00e7\u00e3o previsto na LC n\u00ba 214\/2025 para 2026 oferece uma janela para estruturar a Folha PJ antes de o cr\u00e9dito tribut\u00e1rio entrar em vigor.&nbsp;<a rel=\"follow\" href=\"https:\/\/managefy.com.br\/blog\/comparativo-plataformas-gestao-pj-brasil\/\">Plataformas dedicadas ao ciclo PJ<\/a>&nbsp;j\u00e1 operam com fluxos que vinculam nota fiscal, valida\u00e7\u00e3o de dados e pagamento de forma rastre\u00e1vel. Empresas com&nbsp;<a rel=\"follow\" href=\"https:\/\/managefy.com.br\/blog\/compliance-pj\/\">compliance PJ estruturado<\/a>&nbsp;se posicionam para aproveitar cr\u00e9ditos tribut\u00e1rios e atender aos crit\u00e9rios documentais que os tribunais avaliam. Segundo o levantamento da Managefy, a maioria das empresas analisadas ainda n\u00e3o disp\u00f5e desse processo.
