O debate destacou a recorrente dificuldade das empresas contratantes em comprovar, documentalmente, a natureza comercial da rela\u00e7\u00e3o com os prestadores.<\/p>\n<p>Um <a rel=\"follow\" href=\"https:\/\/managefy.com.br\/blog\/compliance-pj\/\">levantamento conduzido com 300 empresas contratantes entre 2024 e 2025<\/a> identificou que 93% apresentaram falha em pelo menos um dos tr\u00eas crit\u00e9rios avaliados pelos tribunais para diferenciar presta\u00e7\u00e3o de servi\u00e7o de v\u00ednculo empregat\u00edcio: contrato com escopo de entrega definido, registro peri\u00f3dico de entregas vinculado ao contrato e pagamento condicionado \u00e0 nota fiscal emitida pelo prestador.<\/p>\n<p>Conforme o artigo 3\u00ba da <a rel=\"follow\" href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/decreto-lei\/del5452.htm\">Consolida\u00e7\u00e3o das Leis do Trabalho (CLT)<\/a>, os tribunais analisam esses tr\u00eas elementos para decidir sobre a exist\u00eancia de v\u00ednculo. Quando os tr\u00eas s\u00e3o apresentados de forma consistente, a rela\u00e7\u00e3o permanece como comercial. A aus\u00eancia de qualquer deles pode levar \u00e0 reclassifica\u00e7\u00e3o como rela\u00e7\u00e3o de emprego.<\/p>\n<p>F\u00e1bio Rodrigues, especialista em gest\u00e3o operacional de prestadores PJ com 22 anos de experi\u00eancia em consultoria e fundador da Managefy, plataforma de gest\u00e3o de prestadores PJ para empresas, explica que a maioria das empresas ainda utiliza e-mail, planilhas ou sistemas adaptados ao regime CLT, o que impede a gera\u00e7\u00e3o da documenta\u00e7\u00e3o exigida. &quot;O contrato PJ \u00e9 leg\u00edtimo. Em abril de 2025, o ministro Gilmar Mendes suspendeu nacionalmente todos os processos relacionados ao tema. Em fevereiro de 2026, o <a rel=\"follow\" href=\"https:\/\/www.contabeis.com.br\/noticias\/75066\/mpf-da-parecer-favoravel-a-pejotizacao-no-stf\/\">Minist\u00e9rio P\u00fablico Federal emitiu parecer favor\u00e1vel \u00e0 pejotiza\u00e7\u00e3o<\/a>, defendendo a constitucionalidade de contratos alternativos \u00e0 rela\u00e7\u00e3o de emprego.
